Article 1
The driving school must adhere to the following rules:
- The student receives practical lessons from a driving instructor who meets the requirements of the WRM (law on driving instructions for motor vehicles).
- In principle, the student takes the practical exam/ driving test in the car in which driving lessons are given. Only in the event of incapacity, it can happen that the student takes the test in a replacement car.
- The driving lesson consists of 60 minutes and must be fully utilised by the student.
- The driving school has an appropriate insurance in case something happens for which it is liable to the student.
- If the lessons cannot take place, the student will be informed as soon as possible and a new appointment will be made or a replacement instructor will guide the lesson. In such a case, the student cannot claim reimbursement and/or compensation.
- The car is clean, tidy and maintained. No smoking in the car.
Article 2
The student must adhere to the following rules:
- To take driving lessons, the student must be at least 16.5 years old. The student must also always have an ID with him/her during lessons.
- The student ensures that he/she is ready for the driving lesson on time and at the agreed location. If the student is a little late, the instructor will always wait 15 minutes at the agreed location. If the student is not there by then, the driving school has the right to charge for the lesson.
- The student may cancel or reschedule a driving lesson. This must be indicated by the student at least 48 hours in advance in the PlanGo Student App or the OnMyWay app, otherwise the driving school has the right to charge the entire amount of the lesson.
- A lesson cancelled too late will not be charged to the student if there is an urgent reason. Urgent reasons include: the death of a close relative, a funeral, an emergency hospitalization and an unexpected illness. Non-urgent reasons include: matters that you forgot to report in advance such as long-term illness, a dentist visit, a hospitalization, vacation or the like.
- In case of illness, the student must report this as soon as possible via info@rijschool-in-zicht.nl and state what the complaints are. The lesson will not be charged for the first sick report, the lesson price will be charged for a second sick report. When the student is better again, this must also be reported via info@rijschool-in-zicht.nl.
- The student provides all necessary information relating to his/her driving ability regarding his/her medical and/or psychological condition, medication, alcohol and/or drug use truthfully to the driving school.
- In the event of damage resulting from the situations mentioned in 2.6, the driving school has the right to recover this from the student.
Article 3
The following conditions apply to payments:
- The student is obliged to pay the costs for the driving course to the driving school in time. The student will receive an invoice for this. The total amount (or the first installment in case of payment in installments) must be paid before the start of the driving course. In the case of an exam, any outstanding invoices must be paid before the start of the exam.
- If a student does not pay on time, the driving school will use the following procedure: if there is a payment arrears, you will initially receive a verbal warning. The driving school may then charge interest on the amount owed after 14 days have passed since the invoice date. This interest amounts to the statutory interest.
- Should it nevertheless happen that the student does not pay, the driving school can call in a debt collection agency. The additional costs are then for the student.
Article 4
Exam or Re-exam
- If the student does not appear or appears too late for the (re)exam, the costs for the missed and new application will be borne by the student.
- If the (re)exam is cancelled due to bad weather, for example due to ice or snow, the student does not have to pay for the new test themselves.
Article 5
Termination of a lesson agreement
- The driving school has the right to terminate the agreement if it appears that the student has deliberately not provided any or incorrect information to the driving school (see article 2.6).
- The driving school has the right to terminate the agreement if the driving school strongly suspects that the student is deliberately not cooperating with the progress of the lessons.
Article 6
Lesson packages
- If the student has purchased a lesson package and is not ready for the practical exam at the end of the package, the student cannot yet use the exam. The student must then first take extra lessons until he/she is ready for the exam.
- The student is responsible for obtaining the theory certificate on time. Without a valid theory certificate, no RIS test (interim test) or Practical (re)exam can be reserved or taken. The driving school is not responsible for the driving course taking longer and possibly exceeding the number of hours of the package (and the additional lesson hours that must be paid for).
- A driving lesson package is valid for 18 months. It is possible to temporarily interrupt the driving course within this period, (internship) abroad, pregnancy or other causes that prevent the training. The student must notify the driving school of this in writing. In the event that the driving course is interrupted, without giving a reason and there has been no contact for a period of 1 year after the last driving lesson, all rights expire.
- In case of early termination of a lesson package, the following refund will be made: (amount paid by student) – (number of hours * ‘single hour’ rate) If a package has not been completed in full, including the exam, no package discount will be given.
Article 7
Disclaimer
If the student receives a fine during the driving lesson or driving test and/or causes damage to third parties, the following agreements apply:
- Under normal conditions the student is not liable.
- It is forbidden to be under the influence of alcohol and other substances that can affect driving ability during driving lessons. If it turns out after a collision that the student was under the influence, the student can be held liable. It is also forbidden to take medication that can affect driving ability during driving lessons. In that case, the student can be held liable in the event of a collision. So always contact the driving school if you have to use such medication.
- The driving school will ask the student if he/she has a driving ban. This can be obtained, for example, if the student was driving a (moped) bike while drunk and was summoned to court. In such a case, the student is also not allowed to drive a car. If the student has not told the truth and still takes driving lessons, the student can be held liable for any (financial) consequences such as fines and/or damage caused to third parties.
Article 8
Dashcams
The tuition car is equipped with a dashcam in the front and a dashcam in the back. The following aspects apply:
- The dashcams are on by default during lessons. If the student does not want this for any reason, they can of course be switched off. However, it is the student's responsibility to make this known to the driving school before the start of the driving lessons.
- The dashcam images of the driving lessons are primarily used as an educational tool to review traffic situations during or after the lesson.
- Dashcam footage that has been created is not saved and stored by default. When the storage capacity is full, older footage is overwritten. If the student wishes to view footage of a specific traffic situation, it is advisable to inform the driving school of this as soon as possible.
- No integral images of a driving lesson will be made available, it only concerns specific traffic situations. It is therefore not possible to watch an entire driving lesson.
- The driving instructor has an emergency button to ensure that images, for example in the event of a collision or other dangerous situation, are immediately saved and cannot be overwritten.
- If the student wishes to review specific situations recorded during the driving lesson, the student can submit a request for this. Reviewing these images is not a right. When assessing the request, the driving school takes into account various aspects, such as the privacy of those involved and possible conflicting interests. The decision to make the images available always lies with the driving school.
- If images are made available to the student to be able to watch them back with parents/guardians, for example, then these will be made available via a shielded YouTube channel. It is not permitted to distribute these images yourself without prior permission from the driving school.
- The CBR does not allow recording of images during interim tests and exams. For this reason, the dashcams will be switched off and it is therefore not possible to review images of this.
Article 9
General Terms and Conditions (GTC) and mediation and disputes
- The GTC are always available for inspection at the office.
- The GTC can be found on the website.
- These Terms and Conditions are exclusively governed by Dutch law.
- In the event of a dispute, the driving school and the student will first attempt to resolve the matter together; if the student is a minor, the dispute will be discussed and settled with the parents/guardian.
